My husband has been ill for the past couple of months, so I haven't had much time for Gather. However, in my semi-free time I have been putting together some poems for publication.
Since I have been on Gather, I have received some wonderful comments from readers about my poems and I would like to include half a dozen or so of these comments in the back of my book. I've thought about using those from people around the world...Spain, Ireland, England, Sweden, Nairobi, Australia, Russia, the US, etc.
Now: since these have already been posted on Gather for the world to see, are they public property? Does anyone have a problem with my using the comments to further my book? Or should I try and contact each person who commented personally and ask for their okay? My main problem is: I don't know the real names of my commenters.
Any thoughts would be welcome.

Here are some clauses from the Gather service agreement that I got from "Bill's Spirit" that should clarify the issue. It would seem that Gather retains a rigfht to republish, but that the copyright belongs to the poster. You would, therefore, need to get permission for reprinting from the commenters. Goof luck!
Section 6. REGISTRATION AND MEMBERSHIP
c. Gather does not claim ownership of Content you submit or make available for inclusion on the Service. However, with respect to such Content (including but not limited to articles, comments, photos, graphics, audio, or video you submit or make available), you grant Gather a world-wide, royalty free, perpetual, unlimited, and non-exclusive license(s) to use, distribute, reproduce, modify, adapt, create derivative works, publicly perform and publicly display such Content via the Service or on any other Gather property. Gather reserves the right to syndicate the Content submitted, posted, and/or displayed by you and to use that Content in connection with other services offered by Gather. You also agree that, if you post Content containing adult or sexually explicit material that is not suitable for minors, you will mark the Content as such. If your posted Content contains material that is adult or sexually explicit and you do not mark it appropriately, Gather shall have the right to cancel your membership.
Section 10. NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Service (including your Gather username) or Content you do not own, use of the Service or Content you do not own, or access to the Service or Content you do not own, without the express written consent of Gather.
Section 15. GATHER'S PROPRIETARY RIGHTS
(3rd paragraph) Gather and the Gather logo are trademarks and service marks of Gather and other Gather logos and product and service names are trademarks and service marks of Gather (collectively, the "Gather Marks"). Without Gather's prior permission, you agree not to display or use in any manner, the Gather Marks.
Best bet is likely to track down permissions where possible though, I would think ... but perhaps some of us could help with that?
It would be a fascinating book and I'd love to have a copy when you do get it published.

You've all been very helpful. Maybe the easiest way to do this is to grovel, and ask friends for soemthing I can include.
I think this makes good sense. You won't have to worry at all about copyright or Gather.

School vacation week....I flew down to Tampa,Florida this morn to get some sunshine! Imagine a 3 hour flight brings me 72 degree temperatures. No snow, either.

Although Trafford Publishers have all my stuff, I have yet to talk to a human being, so I don't know how much my book will be. That is, how much it will sell for. (More pages, more money). In the end, I decided not to use Gather writers' remarks, but hold them to my heart on days when I think I'll never publish another word.
Funny thing...As soon as Cedar Springs, my book of short stories, was published and on the local book shelves, I never wanted to look at it again. I feel exactly the same about the poetry.
However, when the poems are published, I plan to go at my files and toss out all my bumbles and grombles, notes and slips of word soup that I have collected over the years.
Not that I expect to leave this planet tomorrow or the next day, I do have an urge to purge. Then maybe that's just a yearning for spring.
