Thank you for your letter of February 28, 2008, calling our attention to copyright infringement on our website, Gather.com
Gather is a social media site, providing a user-driven content and social networking platform to our members. All users of our site must first agree to our Terms of Service (TOS), which include the following provisions:
"You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages and/or other materials ("Content"), whether publicly posted or privately transmitted via the Service, are the sole responsibility of the person from which such Content originated. This means that you, and not Gather, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. Gather does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Gather be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service."
And
"You agree that you are responsible for your own conduct and communications while using the Service and for any consequences thereof. You agree to use the Service only to send and receive messages and material that are legal and proper. By way of example, and not as a limitation, you agree that when using the Service, you will not... post any Content that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party (the "Rights"), unless you are the owner of the Rights or have the permission of the owner to post such Content..."
As a courtesy to you, we have notified (name removed to protect the thief because that is the gather way (i added this)) the publisher that we have received your email and that you may choose to contact him directly. We have also removed the image from Gather.com.
Our standard practice is to give members the benefit of the doubt,(This is so damn stupid) educate them regarding the TOS and Guidelines((((you didnt educate him to well he still has images that do not belong to him posted))) and give them an opportunity to correct their actions on the site. We have rarely closed a member's account on a first offense. Based on community input regarding the egregious copyright violation that occurred against Sue M., and our further investigation of the offending member's account, we opted to close that particular account. But this was done only after careful consideration; it was not done lightly or as an emotional reaction to the situation.(((sounds like someone is playing favorites if you ask me)))
We have heard the suggestions of members asking us to review our technology in hopes that images can be made more difficult to copy - this is something we are raising to our Product Board. As you may already know, if someone is determined to steal another's online content, this can still be done. However, if there are features we can include on Gather to make this more difficult to accomplish, this certainly sounds like something to consider.
Although there is no fool-proof technology available to prevent people from lifting images from one website and putting them on another, there are steps we can all take to make it more difficult for images to be copied. They are as follows:
1. Place a Digital Watermark and/or Signature on your image(s) (((ya right these can be removed)))
This will definitely accredit your image(s) to you. However, it's important to note that watermarks can be cropped out of photos and even removed with imaging software.
2.List your copyright on every page of your published content (((sure that will stop them, right!!)))
Although this action won't necessarily stop individuals from lifting your images, it will inform people that you are organized and your work is cataloged.
3. Share only small, low resolution images ((( makes photos look like crap and no one will want them has gather actually seen that image theives will steal any image they can look around you see stolen low quality photos all over this site)))
This way, if your images are blown up or re-edited they will appear pixilated and ultimately un-viewable.
4. Make your images private or available to only select groups or people. (((we are here to share our photos if we do this then why bother being a part of a community)))
By limiting the exposure of your images to only people you know and trust, the likelihood that your content will be stolen is greatly minimized.

This is just a bad situation. I hope gather resolves the problem and takes the theives off the site period.
Please don't feel like Gather is playing favorites... in my case, the person had been found to have stolen numerous photos, plus Gather had proof of my photo being for sale in the person's calendar on Zazzle.com.
If this is the same person that you emailed to me recently... that person is a member of your =Feathers= group... so you might want to delete his membership...
As for the squirrel, I love it anyways!
i just dont believe in the second chance thing when it comes to theft. Unless this guy grew up in a box he knows its wrong. And he has not even bothered to contact me and say hes sorry. Hes getting off with out even a slap on the wrist. There need to be some sort of punishment. he basically shoplifted my photo
please email me the who...my one hitch was if you were sure...and if it was your photo...that does it!
Any other site would fillet this guy alive, especially Deviant Art, they would run him out like an angry mob.
Everyone who knows about this slime bag should make drownrating and flagging his content priority.

Angela, this is about verbatum the response I got to my reply to their earlier email to me. I REALLY think Gather is just waiting for oh, Disney or Hallmark or some other deep pocket corporation to hit them up with copyright infringement suit threats before they get off their tails.

And Angela, I think you're hitting on something bigger than you thought. If we ALL boycott groups that a known thief belongs to, maybe the group owners will delete/block them quicker, and eventually said thief becomes more and more isolated.

I would like to point out the letter sent by Carolyn accurately states Gather's policy regarding copyright offenses as outlined in the Gather TOS and in accordance with the DMCA.
We do try to educate members regarding copyright when a first offense is brought to our attention. If any member repeatedly violates the TOS the actions we take are appropriately more severe, including account closure. I hope you don't feel we have played favorites in this regard. We take all reports of violations from copyright holders very seriously.
It's just not right. I hope someone else comes forward if they see something of theirs so he will be banned.
I also think that part of your "education" should involve requiring the offender to apologize when another Gather member was the direct victim of their theft.
I know photos are regularly lifted from other sites and posted here. Everybody does. Most of us don't like it (though some don't seem to care - probably the ones who do it themselves since there are so many of them), but... Somehow when it is one group member stealing from ANOTHER group member, that offense is, well even more offensive.

Maryanne, its the same if someone stoled your purse that was sitting in a shopping cart while your back was turned, I bet when the cops caught the guy you would not want them to just educate him its wrong to take people stuff((everyone already knows this)) and then set him free, especially when the cops let him keep the cash(points) he got from selling something of yours.
I say at the very least this persons account should be 0'ed out and the points donated to charity.
I am very disappointed in Gather for not removing the thief.
I for one am very uncomfortable knowing he is still in our midsts.
If we all worked harder to discover who he stole other photos, I'm sure Gather would remove him...BUT why is that left for us to do???
I honestly think that not enough of us yelled loud enough.

Maybe his contacting them will give them a kick in the butt, since we've not been able to do it.
This particular "thief" seems a bit off the beaten Gather Path, but SOME of them (and we know there are many) are posting new pictures probably as I type this that they very conveniently lifted from some other site or scanned in from the calendars and gift cards they bought at the mall, and they'll wind up on the highest rated/most viewed/most commented on lists by some time tomorrow. Until people stop rating and commenting on these stolen images so there is little incentive to post them, it will continue happening. And no, it is really not all that hard to tell. Just look at the poster's other images, read the captions and the comments they make to those who comment to them. The thieves rise to the bottom (yes I typed that the way I wanted it) very quickly.
I can't wait to see what comes of the light house photographer's complaint! You deserve a community award for tracking down photographers who have their work stolen!

I've already either deleted or moved a good chunk of my stuff to private (got bored, haven't had a chance to get back to finish the task) and cashed out as many of the points as I could ($150 worth of HD cards on the way). Mostly I'm here now because I was about 100 pts short of another $25 card and didn't want to waste those 1400+ points.
