Why the rush?
A tentative version of the new, proposed immigration bill was first made available to the Senators at 2:00 AM on Saturday, and the Senate leaders are pressing for a resolution by Memorial Day. That’s only five days from now and, in its final form, the bill will be hundreds of pages long. What’s going on here?
Under these conditions, One must wonder how many of the Senators will really be aware of the bill’s contents by the time they cast their vote. In previous situations similar to this, important provisions have slipped through the cracks without the consideration they deserve.
Seemingly, the least objectionable measures in the present bill would call for the hiring of some 6,000 additional Border Patrol officers, building more fencing and vehicle barriers and expanding surveillance by adding radio towers and aerial drones. More pressure would also be put on employers to avoid hiring illegal aliens.
But beyond these provisions, which may not be effective enough to even slow down the pace of illegal immigration, there is considerable controversy.
So far, most of the rhetoric is being directed towards the question of whether the bill is actually offering “amnesty” to the estimated 12,000,000 illegal aliens that are now here. President Bush and the framers insist that amnesty is not part of this legislation, basing their contention on the fact that there is a fine involved along the pathway to citizenship.
However, in what has become partly a tussle over semantics, Republican presidential candidates Romney and Huckabee, claim that “amnesty,” by any other name, is still "amnesty."
Regardless of how it’s interpreted, the proposed legislation appears to be in for an uphill battle. Yesterday, lawmakers from both sides of the aisle took shots at it and there were heated exchanges on the Senate floor.
Furthermore, of all the candidates from both parties, McCain is the only one that has come out in favor of it, although Giuliani has safely avoided offering any direct comment so far.
As it is being considered at this time, the bill would provide a pathway to citizenship for illegal immigrants who were in the country prior to January 1, 2007. In order to qualify, they would have to pay $5,000 in fines and $2,000 in processing fees. Furthermore, the heads of the households would have to return to their home country and then reenter the United States legally. In the process, all family members would have to pass background checks.
Given, the degree of distrust for our government that exists in the immigrant community, common sense would dictate that not too many illegal immigrants would take the United States up on this deal, an estimated 18-month process, even if they could afford it.
Therefore, it seems reasonable to assume that this provision, if approved , would be largely ineffective.
However, while most of the attention is being focused on the word “amnesty,” it’s a good bet that corporate America is holding its breath with its fingers crossed. In a major concession to the Republicans, the bill contains a significant change in how the immigration process will qualify new legal residents down the road.
With less emphasis on family relationships, future immigrants would be rated by a system based on merit points. Under this new guest worker program, green card applicants would be awarded a maximum of 100 points. Half the points would involve job qualifications with the highest points going to such skills as engineering. Credits would also be offered for a U.S. job offer, U.S. work experience, educational background and the ability to speak fluent English.
Corporations are claiming that this system will keep America globally competitive. Others are saying that this is just another way of sticking it to the American worker.
Whatever the point of view, one thing is clear. Instead of just being limited to cheap, low-level labor, the business community would, under this bill, gain access to cheap, skilled labor.
Democrats in the Senate tried to eliminate the proposed guest worker program yesterday. However, reflecting the clout that comes with millions of dollars in corporate contributions, the effort mustered only 31 votes.
Thus, American workers, already battered by job outsourcing and layoffs, could now be faced with the possibility of a government program that would encourage unwelcome competition from immigrants.
The Center for Immigration Studies in Washington, DC is planning to release a study this week that will show “that foreign, highly skilled workers earn less than Americans with comparable skills and education.”
Meanwhile, corporate America’s claim that it can’t find enough skilled workers simply doesn’t hold water, except, possibly, in isolated cases.
The Carnegie Foundation reported that, for the fall of 2004, there were 17,568,606 students enrolled in American institutions of higher learning. It defies logic to claim that this pool of talent is not producing the graduates that the nation‘s businesses are calling for.
Layoffs, which involve many highly skilled workers, represent another pool of potential job candidates. On February 6th, the international outplacement firm, Challenger, Gray & Christmas, reported that U.S. companies laid off 275,921 workers in the previous two months alone, the highest two-month total since they started tabulating job cuts in 1993.
What this country needs is legislation that effectively stops illegal immigration in its tracks, and, at the same time, protects the integrity of the American workforce.
What this nation doesn’t need is a hastily contrived bill that accomplishes neither.

That being said, however, I still would rather see immigration weighted in favor of those who contribute more to the society and who are less likely to wind up on welfare or receiving free medical care. The government needs to crack down on employers who pay foreign-born workers less than Americans would make doing the same job. It's not any different really than employers paying women less than they pay men for the same work.
This bill, I hope, is doomed to failure. I've read it. It's a disaster waiting to happen. By the way I disagree that family first is the way to go with immigration. There have to be other factors in play other than an accident of birth, such as whether that person possesses skills (high end or low end) that the economy needs. Speaking English should be mandatory. The bottom line should be what the person can offer the country, not what the country can offer the person.
Amnesty implies, actually says outright, no penalty. A 5000 dollar fine might seem like a mosquito bite to some people, but at 300 dollars a week of income before taxes, it represents about 17 weeks of labor. About four months.
That is hardly "amnesty." Add onto that travel to the Native Country, at personal expense, and you are again putting punitive measures into the bill.
There are two possible reasons for opposing this legislation. One, it is too soft on lawbreakers. A comparable crime, trespass, rarely includes a fine as high as five thousand dollars. Fugitives who are also illegally in the country will be identified by the requirements, and they will face deportation.
The employer requirements for verification are not to take effect until the bureaucracies involved are able to process the requests. But they also carry severe penalties for violations.
Bringing illegal workers out of the shadows will do a lot to alleviate the problems associated with any underground, and will tend toward assimilation.
There are some real legalistic objections to the compromise, and I offer no excuse for changes in the legal system to provide a reduction in penalty. At present the law has only one remedy. Deportation, and prohibition of reentry. Not altering that provision is destructive economically, and in human terms both.
This is not a perfect solution. It is a workable solution, and it needs to be passed as speedily as possible to untangle the web of deceit and exploitation that the present law created.
Another great article David. God forbid we have educated, English speaking future immigrants. I have to wonder that under the merit point system, would an educated immigrant like you describe with skills in engineering and the ability to speak English truly be paid at skilled cheap labor rates? I wonder if they would make more than American women who can't seem to compete with American men. I have to wonder if we (women) would fall further down the food chain?
I also agree with John Porter. Illegal is illegal - go home. There is no way that these people should get anything - they broke the law - period. Send the illegals home and open the doors to those who have been trying to get into our country legally. And the heat really needs to be turned up on these corporations who are hiring illegals. Believe me, I would rather pay more for my lettuce and blue jeans than to have this continue on. Wait a minute, I do pay a lot more for my lettuce and blue jeans - what's up with that? I thought cheap labor was taking care of this? We pay a lot more for gas and I doubt illegal immigrants have anything to do with that. NObody is going to willingly go back to their country. We'll have to assist them home...

1: Are you an illegal immigrant ?
2: Are you married to an illegal immigrant ?
3: Are you having sex with an illegal immigrant ?
4: Do you have illegal immigrants working for you ?
If your answer to all of the above questions is no, then what exactly is your FREAKING PROBLEM ?

I went to the March in Boise, there were 15,000 of us "illegals" there.At this march I saw no disrespect for flag or country,the local Aryans came out with their wild claims of upside down flags and dragging flags, who you believe will depend on your hate.
The hate jockey said a local Jr. High schoolexpelled a student for refusing to salute the Mexican flag. An idiot believed it and called asking which school it was so he could"confront" them. The Hate Jockey back peddled because he knew his lie could result in death, but he would not admit he was lying. I was at work but I immediately called the school to warn them.
However, it was determined that due to postal regulations, the tea bags would not make it there. Therefore, the national campaign is asking everyone to mail the tags from the teabags-----with "No amnesty, enforce our laws" written on each one.

"If you look at some of the provisions in this proposed new law, it's not hard to see why the minority leader is thinking and speaking the way he does. Among the worse provisions, one we just reported on in Bill Tucker's report. Illegal aliens would be given legal status just one day after their application is filed, even if the background check isn't completed. And it could not be in nearly every instance.
Other absurd provisions in this legislation, taxpayers unite. You'll be paying for the immigration attorneys to represent illegal aliens. How is that for a deal? You've got to love America.
Supporters of the legislation called the new Z visas temporary. What they don't want us to tell you is that the new visas can be renewed indefinitely.
And gang members, illegal alien gang members, are eligible for amnesty. The heritage foundation estimating there are, by the way, at least 30,000 illegal alien gang members in 33 states. All they have to do is say they don't want to be a gang member anymore and bingo.
The federal government with taxpayer money, your money, will be helping the Mexican government provide enough incentives like a decent education and health care for Mexican citizens to stay in their country. And another provision of this legislation, illegal aliens don't have to pay those cumbersome, nasty taxes.
This is, I think, what we would call a very, very generous amnesty program. A lot of folks would like to get a hold of this opportunity.
And a proposed new Security and Prosperity Partnership, the North American union, which would effectively erase borders among the United States, Mexico and Canada, would be given top priority, Fast Track for SPP.
Border security not first in this bill. We can't even find out what border security has to do with this legislation. It is all about amnesty.
And the proposed 800-mile-plus fencing on our southern border could be slashed to just 200 miles. The Senate bill incorporating the so-called Dream Act that gives in-state tuition to illegal aliens a benefit, of course, denied American citizens. Illegal aliens will, under the terms of this legislation, also be able on cut in front of everyone who have been waiting for years in their own countries for admission to the United States legally. Suckers.
And another outrageous provision. This bill highlighted in -- the Heritage Foundation released today its own list of worst provisions.
Get ready, because among them, amnesty for illegal aliens who were ordered deported. That was unfortunate. Heritage says our immigration courts could be effectively shut down with this legislation, as judges must close any immigration proceeding and allow illegal aliens to apply for amnesty.
Senator Jeff Sessions today also saying there are a number of other loopholes in this law. Among them, he points out learning English not required until the ninth year of amnesty. Illegal aliens will be eligible for the earned income tax credit. They don't have to pay back taxes, but they will be eligible for the earned income tax credit. A tax credit, by the way, of course, designed to help this country's hard-working men and women, citizens all.
---The Z visa would transform an illegal alien into a legal resident in 24 hours, allowing the holder to stay indefinitely.
To get one, all an illegal alien has to do is prove that they've been working illegally in this country by submitting a pay stub or a bank receipt. A remittance receipt will do as well.
Fingerprints must be submitted, and a non-relative must swear out an affidavit that the illegal alien was here before January 1, 2007.
Whoever wrote this provision, giving the government only one day to figure out if a person is a criminal or a terrorist, has no clue how this information is actually maintained. You can't get that information in 24 hours.
And if the federal government fails to get that information, all of us are put at risk by this bill.
And more good news for the illegal alien applying for amnesty. After the 24-hour period passes, those applying get valid Social Security numbers.
And the process even grants forgiveness for those who have been convicted of two misdemeanors. No medical exam is required."

$5000 is cheap for slave labor. Do you really think it is going to be the illegal that pays this? In todays inflation adjusted dollars, what would be the price of a slave? This is a clever way to exploit the weak at a huge discount. Corporate America will recoup the $5000 in less than a month, by the time you account for the cost of legal citizens wages and benefits. If you care to debate cost accounting, I would be more than happy to accommodate you, as I designed many cost accounting systems for many fortune 50 companies and the federal government.
American workers, have been reduced to working for Walmart for substandard wages and are dependent on additional federal money, just to keep a roof over their heads. While your new corporate insourced work force, take formally high paying jobs and reduce them to minimum wage careers.
The employers, that bother to withhold taxes and SS, will not even cover a portion of the expense these folks impose on society. Education, Food, Medical Care, and eventually Social Security and Medicaid/Medicare Benefits. This at the same time, our crack Representatives are attempting to steal all the Social Security of those that have worked for 50 years like me.
I couldn't disagree with you more. $5000 is a pittance. It is lipstick on a pig, meant to fool the weak of mind.
As for amnesty and a path to citizenship that is a sham. $7,000 is a of a lot of money for most citizens to come up even if they are members of the middle class. For most illegal immigrants it will be a bar to obtaining citizenship unless someone else comes up with the cash.

Our CIA types have a long history of 'covert' operations where they infiltrate organizations and work from the inside of them to destroy their aims. These tactics have always been employed all over the world.
Of course this is something the far right will at least 'want' to deny, they so like to be behind their leadership 100% who they want to believe are always looking out just for them with 100% honesty.

As an American I am responsible for obeying the laws of the land. If I violate the law, then I must face justice. That could mean great suffering for my family. There should be no exceptions made. Their first act was to violate the laws of the land.
My question to you is, how is it right to displace American workers, with cheaper, illegal workers. What do we do to ease the suffering of these folks. Many of the jobs, that will be lost, aren't on the farm, but will be high tech jobs, that people who followed the rules, and made great sacrifices, to learn, will be faced with the choice of not working, or working for a lot less.
Charity begins at home. Let's get all the sick, disabled, CHILDREN, and working poor health care, before we worry about insuring the economic refugees from other nations.
Finally, who benefits most from an illegal work force? Not main street, but Wall Street. Don't listen to the spin. Look inside your own wallet, and see if your really better off now, then you were pre globalization.

My ancestors came here LEGALLY. They had to wait forever and complete endless mounds of paperwork. They had to have health screenings. They had to prove that they would not be a burden upon society or other citizens. They assimmilated, learned the language, and became part of the melting pot.
They did not march in the streets demanding anything----especially if they were not entitled to it.
They did not apply for and use every/any social benefit available----WIC, welfare, disability, foodstamps, etc.
Wasn't it pointed out under one of your other articles that you live in one of the VERY wealthy, gated communities in California??
What, are you afraid that you are going to lose your gardener, pool cleaner, housekeeper, etc.???
Illegals can't bother you once you drive through that security gate and get into your house...huh??? Who cares what happens to anyone else.
Also, just think about this. Suppose an American citizen broke a law, and has to do jail / prison time. The citizen who broke the law is married with children, and often in cases such as this, the family is torn apart, which is exactly what happened to this citizen in this case. So who's fault is it that the citizen's family is torn apart ?

What of the other countries who come to our "country" ilegally, Why is it only one country that is mentioned. Yes I have friends who are Mexican, and they have their papers to prove they are legal here. Yes I'm married to a Mexican who also has his papers to prove he is legal here, but thats not why i'm outraged. I'm upset that this whole immigration thing is targetting one race and not all races. My husband and I are trying to get his only living parent up here to be with us in the last years of his life, and we are doing it the right way thru immigration. My husband has worked hard to get where he is now. He supports me and our unborn child, I no longer work but can stay at home and care for my child when he or she is born. I see no one has mentioned the CONSTITUTION and rightly so because its true or forefathers were more considerate than we are today. They didn't turn anyone away. Even thru the depression no immigrant was turned away. Now we act as though we are god and can ignore the plight of others who are in need, but we are not god because he states in the bible to love our fellow man and after reading every thing here I can see that alot of people forgot who created man, all men equally and in his image. That is the reason I called everyone a HARD-HEARTED RACIST. If I'm wrong then prove me wrong, which I know you can't because you forgot were you came from. When my son was killed the only thing that was said was that afour year old was killed in an unforunate accident, no mention of the driver being drunk or the name, but a week later another drunk driving accident accured and the name of the victim and the driver was mentioned why because of the childs name. You have no right to talk of compassion because from what I have read here no one has any.
That is because 67% of illegas are coming from Mexico and 27% from all other Latino/Hispanic countries.
Unfortunately, your illegal friends and family are no longer welcome here. The MAJORITY in this country are going to make sure that they are sent back to their own countries-----where they will be free to march, DEMAND, and wave their Mexican, communist, etc---flags forever.

The MAJORITY of US citizens are DEMANDING more arrests and deportations. Also, of course we do not want to break up families-----that is why it is very important for the illegals to take their children with them!!!! The homeless, more than 65% of them are under the age of 18. Many were and are abused. Others suffer from mental illness or drug dependence(the reason rich folks go to Rehab). I assure you it's not a personal choice to live on the street in a majority of cases. When I was a child(12Yrs.), I lived on the street to avoid being beaten within an inch of my life everyday. Guess what, I actually worked a job too. If you would like me to post stats on the homeless and make you look like a complete ass, I will.

There are NO people native to North America. According to current scientific knowledge, no humans evolved in North America or South America but instead arrived by sea or by a land bridge that formerly connected North America with Asia. Most, if not all, of them descend from peoples from Siberia. There were no borders. No country. There were only tribes of American Indians whose ancestors had migrated centuries before. Settlers to North America came on ships from Europe. Settlers formed colonies, states and a country. This one. Then, pioneers expanded it. Not sure how your ancestors got here but after this country was founded most came thru Ellis Island- legally. Had to learn English, the Preamble to the Constitution- of America, Pledge to the flag- of America, - oh, yeah and had to vow allegiance- to America. Just like the long list of 'facts' presented here in some comments ... who's purpose do they serve ? There are various think tanks working feverishly on all sorts of special interest 'projects' to turn out such 'facts' to prove one point or another ... all to affect public opinion into supporting one goal or fighting another ... People have been predicting this tribulation for as long as I can remember. This tribulation was predicted to take place in 1980, though 27 years have since passsed with no tribulation.
I however do believe that a tribulation will take place once the U.S. has sunken to a third world nation, and giving illegal immigrants from third world countries amnesty will more than likely do the trick. Allow them in here as they wish and they will bring the woes they are trying to escape right along with them. Once they have destroyed our economy and infrastructure, the rest of the industrialized world will soon follow. Then you will have your tribulation.

I am an ex-marine, so I've seen death up close and personal. I've seen the hatred of our way of life. Why should we open our borders and take in the rejects from other countries. It's one thing if someone is a political refugee, it's completely different if that person is an economic refugee. I grew up poor. Never enough to eat, not the nicest dressed, so I'm aware of the real poverty that exist in all areas of our country. From inner cities to rural America, there are impoverished families that work hard. What about them?

Poverty has sky rocketed and real net wealth has shrunk for the middle class for the first time since the great depression. Why should Americans roll over, while they are displaced by cheap in sourced labor. At what point does corporate America have to pay a price for exploitation of Americans and Illegal immigrants.
There are two distinct groups in America. Those that must abide by the law, or loose everything including their freedom, then there is corporate America and the Elite. No laws apply to them, and no evil deed is beyond their imagination. A payoff there, a kick back here.
I'm a history buff, and very few of the founding fathers would hesitate to call our current group of elected officials traitors. They have traded their principles for lobbyist bribes. They have no concern for the Little guy, because it's money that gets them elected. The principles of our constitution has been paid for in the blood of it's military. They shed no tears for the lost, because it is the poor and middle class of this country that serve. The very people they disdain.
Let's make sure, before we swing the gates open, that we're not just supplying more victims for the machine. Actually Jerry, you are partialy correct. I got mine, I worked for it and it's mine. I'm not rich, but I worked hard for what I have which is a good job, food to eat, water to drink, a house to live in, a car to get me back and forth from work and a few material possesions. These things wern't given to me, I had to earn them. I'm more than glad to share these things with my family, but there is no way I'm sharing what I have and what we Americans have worked for with a bunch of illegal immigrants.
