Jenelle Evans is preparing to regain custody of her three-year-old son Jace. Her mother has had full custody for the last few years and as of late, she's been ignoring Jenelle's calls to see her son which has left Jenelle feeling like she'll need to get custody if she wants to spend time with him.
"Jenelle is working really hard because she doesn't want her mom Barbara Evans to have custody of Jace anymore," a source close to Jenelle tells Radar Online. "She knows she has to go to court to get Jace back and she's planning to do that but she can't right now because of her legal troubles. Jenelle has been so good about following her probation rules but she's back in trouble after the latest incident with Gary Head."
Gary is Jenelle's ex-fiance. The two had several heated discussions, the last of which led to both of them being arrested and charged with assault and drug possession. After Jenelle goes to court for that, she'll have to get it expunged off her record so that she can go to court for custody with a clean slate.
Prior to the incident with Gary, Jenelle had gotten off probation with no pending court dates, but that one fateful night ended up costing Jenelle big time. If she gets charged, it will make it far more difficult for her to get custody.
Jenelle insists that she is innocent of all charges and plans to fight. She had gone to the first court date for the incident but refused to make a deal with prosecutors and opted for her chance to prove her innocence at trial.
One thing that will surely help Jenelle's case is the alleged abuse that she suffered at the hands of Gary. She appeared in court earlier this month where she presented evidence of his assaults and was granted a no-contact order against him.
Jenelle Evans will return to MTV in Teen Mom 2's third season this fall.
