April 28, 2012. Nashville. Since the day Barack Obama took office as US President, Constitutionalists have been quietly questioning his legal eligibility to hold the office. This week, a Federal judge has ruled with Obama once again that it is a federal matter not a state matter. John they are..read the Constitution.
It is found in the Constitution of the United States, Article II, Section 1, Clause 5:
No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President; neither shall any Person be eligible to that Office who shall not have attained to the Age of thirty five Years, and been fourteen Years a Resident within the United States.
That means that if Arnold Schwarzeneger ran for President, even though everyone knows he's not eligible, he still could do it, simply because there is no process for stopping him. If there is a process somewhere, that's the process they'll probably end up using to go after Obama. So far, nobody's found the process or procedure and every judge, state and federal, has washed their hands of the matter.
Whiteout- thanks. It is obvious to me it should be addressed with legislation for the future, a defined process that applies to all candidates evenly, and perhaps held by an independent body. It's beyond me why the process is held secret in the first place; seems like any Party can do whatever they want, if anything at all.
