Rape is a horrific crime. Sometimes it is committed by men that would not typically be expected to commit such a crime. A woman in New York City claims that she was raped by a cop. Would an officer risk his career by committing a rape?
A woman usually expects to be safe in her own home. That was not the case for a woman who lived on East 13 Street in the East Village in Manhattan. She has accused a police officer of allegedly raping her.
Police officers certainly know that it is never legal to rape someone, even if she is drunk. They are hired and paid to enforce the law, not break it. Do women have to worry about safety even around cops?
Police officer Kenneth Moreno was allegedly recorded saying “It wasn’t done intentionally. I didn’t mean to hurt you. I just got caught up. I’m sorry,” notes the Gothamist. This officer accused of alleged rape also allegedly said, “If you stop drinking, I’ll be your boyfriend. I’m not a bad man. I’m a good friend to have.” By the way he is married with several children. Also, Moreno is also under investigation for a bag of heroin that was in his police locker, notes the NY Post.
How can someone say “It wasn’t done intentionally” about a rape? This crime is too big to try to make lame excuses to justify the incident.
The lawsuit against the two police officers, Franklin Mata and Kenneth Moreno accuses them of alleged official misconduct and burglary. Moreno is also accused of alleged rape. New York City has taken them off active duty.
The incident started after a taxi driver called the police because the woman had vomited in his cab and did not have funds to pay the taxi fare. There is a tape showing the two police officers escorting the woman into her apartment. After the cops left her apartment, the security tape also shows they returned twice in the middle of the night, eventually left at slightly after 3:30 a.m., notes the Gothamist.
The two police officers of New York City are also accused of allegedly stealing the womanÂ’s Blackberry and then making phone calls with it to threaten her brother and mom to warn her to not talk about the crime.
Mata has allegedly informed officials that Moreno did rape the woman. Both cops are still receiving New York Police Department salaries. Moreno earns $150,000 a year and Mata earns $110,000.
The woman who was allegedly raped had a blood alcohol level about 2.5 times the legal driving limit, notes the NY Daily News. She was thus drifting in and out of consciousness. Thus, she was unable to give consent for sex.
While it is best to remain sober and in control, a drunken woman still has legal rights. If the alleged rape occurred, it was illegal and an extreme show of depravity by a police officer.
