What a kick in the arse. I was going to pay rent last night when hubby came home with the newspaper and showed me something in the legals. Our landlords rentals are all going up for auction on Dec. 9, 2009: via foreclosure on all his property.
So I went and looked up court papers (easy to do and for free, just go to your states court site and you can do a search) and I found out that the paperwork had been filed in 2008, and just finally was finalized. He didn't even have the nerve to tell us, and this is one of my husband's oldest friends.
We are going to the bank involved with this later today. In all honestly, because we didn't receive any notice (which legally we were suppose to), we have a feeling he told them that we had moved out and he wasn't paying the bank money due, pocketing it instead.
Now, thank goodness for Obama's stimulas bill that went through in May 2009, that with foreclosure to rentals, the sheriff canNot show up the day after the auction and kick us out. Of course, we aren't waiting. We are going to start looking for places this upcoming week. There is quite a few places around here up for rent. I just don't feel like packing again. I finally had the last box unpacked last week from our big move...and now, got to start all over again.
Not a happy camper right now.

if it were me?
I'd have a lot of 'choice' words for my landlord.
I would also check your laws, because some states have laws that you can't be evicted in the middle of the winter.

You may be able to stay with no problems. Many years ago my landlord defaulted on her mortgage. The holder of the second mortgage got the property and turned out to be a very reasonable landlord. Your situation is more iffy than mine was because of the auction.
In CA it's been illegal to evict tenants in foreclosed buildings without cause for several years. Leases and rental agreements apply regardless. It's popped up in local news periodically since the housing market collapsed.

Well the house we are in , is up for sale because the landlord does not want to lose it to the bank , this way us and the other tenants will still have a place to stay.
But what happened to you is just plain crap!! Nellie why dont you come here and live... it will be crowded but at least it would be fun
