I'm tired of seeing people post articles word-for-word on Gather. Many of them state the source, but offer nothing else aside from the original newspaper article. This is copyright infringement and is not allowed by the US Copyright Law or Gather's Terms of Service. If you haven't read either, you might want to consult them.
Some people think that only using half the article with a link falls under "fair use" of the copyright law. It does not. "Fair use is a copyright principle based on the belief that the public is entitled to freely use portions of copyrighted materials for purposes of commentary and criticism" (http://fairuse.stanford.edu/Copyright_and_Fair_Use_Overview/chapter9/index.html).
Please notice the words "commentary" and "criticism" in that sentence about fair use. That means that if you do not write any commentary or criticism, you are violating the copyright law because it is not covered under fair use. Also "portions" refers to the use of brief quotations within a mostly original work--it does not refer to quoting five paragraphs of a newspaper article.
Please stop posting other people's work and steal online advertising revenue from news media. If you stop this copyright infringement, I promise to stop flagging your articles.

Wow, looks like some people are offended by the truth.

That was after I gave a 10! I think that this is important information, I see people all the time who just C&P a news article and that's it.
Anyway, people shouldn't let a pesky little thing like THE LAW get in the way of earning their points!
The actual word "waiguoren Íâ¹úÈË" really means "a person who is not Chinese," regardless of who uses the word, so I am confused about you name especially with "the Great" behind it.
Maybe you should learn about the language you are chosing to use before you start to critize others that you know nothing about. There are several people on here that have no other way for a little income and you think the world has made you God!
Now I am off to try and rate 10 to as many people as I can regaurdless of what you think!
It's nice that people can ignore the law and take money away from news media so that they can earn a few pennies instead of taking a few extra minutes to do their own work.
For your information I know plenty about Chinese. Maybe if you knew more about the language and me, you would actually make an intelligent argument.
Now go read your copyright law.
Now, see - I'd think if you needed money THAT badly, you'd be extra careful not to do things that can get your account closed or even get you sued.
BS,
B***S**T. Is that your name, or what you do? Did you graduate from MSU? You know, the 'Make Stuff Up' college? Methinks you must have one of these copyright infringed 'articles' 外国人 (Waiguoren) the Great is speaking of... why else lash out at something completely unrelated as how she spells her name? Is that relevant to this post? I think not.
I meant 'he'.... really I did. Sorry. Don't flag my posts, please... lol
"There are several people on here that have no other way for a little income and you think the world has made you God!"
I once had a friend who had no other way for a little income than to shoplift and sell the booty for a discounted price, the LAW had something to say about that, but I'd suppose you would defend her right to do that also?
Just have to learn to live with the C&P and copyright violations. I objected a few times a couple years ago and it did no good. On the plus side, I've gotten some good links for alternative sources for news and views.
"I promise to stop flagging your articles"
Do that too many times and Gather will most likely give you the boot......
Not if it is a valid complaint.
dont know what or how many he 'flagged' exactly, but im sure gather cant be bothered checking out violations on tons of flags..they'll just see him as a pian after awhile. (which doesnt mean i "support" C&P as you said in your ping to me)) it means i DONT support people who go around flagging everything.
"I promise to stop flagging your articles"
I'm think that is a form of Harassment also against the TOS
i think so too sandy....
So who got attacked? This is the main reason I just view and stay away from trouble on here.
I never got attacked. I just started flagging posts that were infringing on copyrights. But from the looks of the ratings on this, I angered a few people who like stealing other people's work.
I think it's rediculous that you people can't understand copyright law. Do you think it's harassment when the cops take shoplifters to jail?
Pathetic.
If you stop this copyright infringement, I promise to stop sending links to the origional owners and getting your accounts closed :)
i believe if a person thinks something (recipe, news, entertainment news, etc) is and can be of interest or helpful to another gatherer, theres nothing wrong with C&P as long as you state where it came from and dont pretend it's yours originally.
"If you stop this copyright infringement, I promise to stop sending links to the origional owners and getting your accounts closed :)" Nothing better to do with your time here but try to figure out the 'original owner' so you can send them links? Again, I think they will just look at as a pain and 'sour grapes'......I repeat, I'm not FOR C&P in most instances, what I do <b>NOT<b> like are self righteous, self appointed 'police' who should mind their own business unless it concerns them directly, and leave the 'policing' to whomever 'took care' of it in the past......seemed to work OK without a few 'gatherers'.....
Robyn, people are perfectly able to search the websites people steal things from to get a recipe. Yes there is something wrong with it, you don't own it nor do you have the rights to use it.
It really isn't hard to find the origional owner. You're forgetting I am a college student and have access to some really nifty search tools that turn up the owners within two minutes of searching. Plus when the dumbnuts steal photos with watermarks it's easy to just google.
If my memory serves me, and it does, you yourself once had no problem in voicing a dislike of such people on here. . . must be getting more attention from that segment of gather now and therefore you've changed camps :)
And members always have policed the site, once through copyright flags and now through contacting owners. Some of us have integrity and support our fellow creative people and their rights to their creations.
" Nothing better to do with your time here but try to figure out the 'original owner' so you can send them links?"
Oh, puhlease. Finding an original owner on a stolen article takes seconds.
someone once sent me an email about someone here on gather stealing my content and posting it. Its a great thing to do for someone that does not know there is someone stealing their content. Gather closed they guys account! It was a wonderful victory over copyright theft and when I have nothing better to do I pay it forward and help others stop copyright theft too. Its detective work and I enjoy doing it. Nothing makes me happier than to slap some cons hands for stealing.
heather, "you yourself once had no problem in voicing a dislike of such people on here".I dont recall the details, but it probably wasnt in relation to a web thing, more like if someone stole someone photos or something and said, 'hey, look at the pic i took".....THAT is wrong...As far as looking over the web for a recipe or news story, we miss things sometimes and dont see everything of interest. When someone posts a link about say, an actor dying (example), I'm like, 'wow, i didnt know that'....
Regarding 'integrity' and "support our fellow creative people and their rights to their creations", I believe in karma, and what goes around comes around, etc, W/O any of MY butting in......
Karma? You're starting to sound like another Robin. My eyes and legs are already spoken for though.
What??
All I'm sayin' is in the years I've lived, I'm a firm believer that people get theirs w/o me doing a damn thing......I've seen it.....and if they don't, well shame on them.....they have to live with themselves.....there's plenty more important things in this world to concern one's self with besides tattling in the name of 'support'........JMO
*GASP*
I left you a 10, brought you up a wee bit :)
I do agree with you on the word for word stuff. today I used a photo from the net, but explained where it came from and told my own story. When I write about something in the news, always tell where I read it, but put in my own words. I might read something like you are talking about and I might comment,or not, but if not original, then no rating. I think that is fair....
Wow. Look at all the people angry that someone has the opinion they should follow TOS and the law. Goodness. The claim that anyone "needs the money" as if that's some kind of excuse is shortsighted, at best, when the penalties are weighed. Where's the money going to come from when your account gets closed? (And they have been.) If you're hurting that badly, how are you going to afford to pay for a lawyer to defend your actions, and, if the judgment goes against you, pay the penalties to the people you have stolen from?
To quote Gather: Copyright and Content Ownership: You're responsible for any content you share on Gather, so you should only share content you created or for which you can provide written permission from the copyright owner. Remember: you automatically own the copyright for content you create. If you share content you didn't create or for which you don't have permission, you may be violating copyright laws and Gather's Terms of Service.
oooh Robyn better watch it girl or you will get flagged. J/K you know I love you. You go girl...
LOL! thanks lora....
This sounds like a shoot the messenger, folks. Why are you made? Just knock it off. It's wrong to steal another's work. The end.
:)
I completely agree! Why should someone copy and paste an article or whatever and post it here and get points that can be turned in for cash or gift cards when they couldn't even bother to take the time and write their own? How is that fair to the original owner? Its not!
I fully agree with you! I think Gather should have editors who remove this material.
I am shocked by the volume of material which is copied from another site and posted on Gather without the author's permission. Perhaps more shocking is the degree to which members defend this activity for any one of a number of reasons.
The fact is that we are all bound by the LAW and also the TOS to which we AGREED when we joined Gather. What we think should be okay and/or why we think so is simply irrelevant.
Well written, and one of the few things on Gather I have ever given a "10". It is amazing to me how many people would rather remain "ignorant" of the law, than just suck it up, comprehend what it says, and change behavior accordingly. GIVING CREDIT to the person you stole it from doesn't make the original offense "right"... it just tells people WHO you are STEALING from!
So, if my neighbor has a lovely new car, as long as I give credit to them as the previous owners, I can steal it right? LOL...
There are a few of us here at Gather who will keep championing this cause and getting the infringers' accounts closed. One of these days Gather will stop rewarding theft!
What makes your article distasteful, and poorly done -- for starters -- is the way you begin it --
"Because Some People Are Too Stupid to Read". That was totally unnecessary, and it would appear that your purpose was to inflame and alienate, rather than inform people.
There may very well might be another article written,
"Is It That People Do Not Value Their Own Work, or Are They Merely TOO CHEAP to Pay the $65.00** For a Copyright?"
Well, whatever the problem, I won't revert to namecalling or putting people down, just because I disapprove of their actions or behaviour.
Thank you for the article; there is absolutely nothing in it that shall cause me to lose a bit of sleep, though.

**$65.00, or whatever it costs for a copyright these days.
Sorry to offend you Neeetah, maybe I should've just used "ignorant" or "oblivious." It's still not an excuse.
