I just filed a lawsuit against my brother.

My brother took power of attorney from my mother and put her house in his name.  He has been taking money from her for years, and now, that house was all she had.  I just filed suit in her behalf, but I have to pay the lawyer as she has no money.  This is so sad.  I have another good brother, who will help, but he can't right now, so it falls on me. 

My brother is so evil.  She just told me, after he took her house, and all her money, she gave him another $600. to eat.  He took her to the bank.  She used her ATM card.  So, I had to cancel her ATM.  I told her I watch her money and if I see anymore large cash transactions taken out, I'll have her declared incompetent.  She's so sweet.  She asked me, "But not this time, right? 

I'm always giving her one more chance.  She's given away over half a million dollars to this jerk who has nothing to show for it.  I hate being in this spot, but I'm going to protect my mother even from herself.   Thanks for the ear.

And yes, I've gone to every authority you could think of.  What a bunch of useless people.

Oh my goodness. That is so sad. I just can't believe that a child could do that to their mother but I know it happens everyday.

you would think there could be more done in such a sad case of elder abuse. I know Washington State has laws but I have never had to use them

Actually, I can see eventually having to do what you've done but she willingly gives him money because he's so pitiful. He's 58 and arrogant. He's nasty to her after she's given him money but always comes back with a sob story. I keep telling her it's time to cut the cord. Ha!

I have an evil brother who likes to mess with our parents' stuff too. They are both passed on, but even when my dad was alive, he would want him to get a mortgage on the house, so he wouldn't have to go to work, and it didn't work when Dad was alive, and neither did it work when he was gone, because I wouldn't stand for it.

I have no other siblings, so I have to do it myself, too.,

Some people are born users and useless people. We certainly do have to protect our parents from their user and useless off spring if they have the misfortune of having a user and useless adult child.

sadly is does happen much too often......my youngest child did it to my mother.....broke my heart....

Some people seem to think their entitlement to use their parents stuff never ends - as if they have right to everything as if they have already inherented it all even though the parent is still alive and needs it themselves. There do seem to be some good suggestions in this thread. Many elderly parents won't say no to a grown child no matter how much they already gave them.

I have to do the same thing to my brother, 5 years ago I started a business on a product I invented, since then I have brought out a few products and last year the business received the Queensland Small Business of the year. When I started the business my brother wanted to be in the business as he was in a bit of a treading water place, I agreed and we had an agreement drawn up. since then when I was overseas he had the business changed and registered in his name and had the bank accounts depleted and started a new account where he was the only signatory. Now he has taken over the company and is refusing to pay any money and it is a legal mine field, where I have no money and to get my business back I have to find a job where I get enough money to pay a solicitor to take on my case.....
My friend's brother did the same to him after 25 years in business, Funny both are OLDER Brothers.....

I'm sorry. We had to declare my mom incompetant because of the brother we lost in January. He was always finding ways to get money from her.

To be declared incompetent, you must have "expert evaluations" from two physicians to present to the court. She should be tested not only for memory, but cognitive losses as well. Her/your lawyer should also subpoena her medical chart from the family physician. If there is anything in that chart related to her state of mind, it will be grounds to overturn your brother's POA, and give you the right to sue for not only what he took, but future earnings as well. Carol, You do what you have to do, and that is the bottom line. It sounds like your brother has been doing this for some time. Did you and your other brother not suspect this was going on prior to his 'house deal?' He is scum and needs a reality check. Good luck and don't back down.
