In this raid, more than 260 workers who were mainly of Guatemalan background, were arrested and charged with identity theft and most were sentenced to five months in prison.
Instead of being just deported these Guatemalans who were guilty of providing false documents with the intent of working were jailed. A first. A crack-down on 'illegals' to make even Lou Dobbs proud.

As discussed in an editorial today from the New York Times, a report by Erik Carmayd-Freixas, who served as an interpreter during the proceedings, revealed the shameful process.
An excerpt from the column:
"The essay chillingly describes what Dr. Camayd-Freixas saw and heard as he translated for some of the nearly 400 undocumented workers who were seized by federal agents at the Agriprocessors kosher plant in Postville in May.Under the old way of doing things, the workers, nearly all Guatemalans, would have been simply and swiftly deported. But in a twist of Dickensian cruelty, more than 260 were charged as serious criminals for using false Social Security numbers or residency papers, and most were sentenced to five months in prison.
What is worse, Dr. Camayd-Freixas wrote, is that the system was clearly rigged for the wholesale imposition of mass guilt. He said the court-appointed lawyers had little time in the raids' hectic aftermath to meet with the workers, many of whom ended up waiving their rights and seemed not to understand the complicated charges against them."

"Driven single-file in groups of 10, shackled at the wrists, waist and ankles, chains dragging as they shuffled through, the slaughterhouse workers were brought in for arraignment, sat and listened through headsets to the interpreted initial appearance, before marching out again to be bused to different county jails, only to make room for the next row of 10."
He wrote that they had waived their rights in hopes of being quickly deported, "since they had families to support back home." He said that they did not understand the charges they faced, adding, "and, frankly, neither could I."
No one is denying that the workers were on the wrong side of the law. But there is a profound difference between stealing people's identities to rob them of money and property, and using false papers to merely get a job. It is a distinction that the Bush administration, goaded by immigration extremists, has willfully ignored. Deporting unauthorized workers is one thing; sending desperate breadwinners to prison, and their families deeper into poverty, is another."
Small additional point. This prosecution was led by Michael Dummermuth, the 35 year-old interim U.S. Attorney, not completely divorced from the U.S. Attorney appointment controversy.
Dummermuth has an interesting record. As described:
"Dummermuth's resume includes a two-year stint at the Civil Rights Division of the U.S. Department of Justice as well as a one-year position in the U.S. attorney's office in the eastern district of Virginia. He served in private practice in Cedar Rapids and worked with Judge David Hansen of the 8th Circuit Court of Appeals. In addition to his diploma from Iowa State, Dummermuth graduated from Harvard Law School in Cambridge, Mass.
There are, however, direct links between Dummermuth and the Bush administration. In addition to small campaign contributions, Dummermuth was one of three field staff for the Bush-Cheney presidential campaign in Iowa during 2000. He directed campaign activities in the eastern portion of the state while Scott Shuman worked central and Grant Young worked western Iowa. The three answered directly to political director Craig Schoenfeld.
In addition, Dummermuth's wife, Rebecca, previously served in the Bush administration's Department of Labor as special assistant to the solicitor (then Eugene Scalia). She also worked in the White House, serving as associate director for legal affairs in the Office of Faith-Based and Community Initiatives."

The point is they aren't being taken out of Iowa. They are being sent to jail. And Postville is hurting because of the loss of jobs. Regular American citizens are feeling the pain. And the "illegals" were contributing into the Social Security System, keeping that program solvent. And those contributions into those pilfered numbers will no longer be continuing.

I don't have a problem with immigration, I have several immigrant friends with whom I went to college, and am thrilled that they opted to stay here and contribute to our economy.
What I do have a problem with is the illegal, undocumented immigration. Illegals in this country account for an obscene amount of uninsured motorist accidents, DUIs, gang activities, muggings, and armed robberies. If they were willing to break the law to come across, it seems they are more likely to be willing to break others as well. This is not to say that all illegals break other laws, there are many who are hardworking, generally honest people. But there are also many who aren't.
Thanks for the comment. Unfortunately, you aren't correct about the statistics. You see, most "illegal" immigrants are afraid of being caught and deported so generally they stay out of trouble.
Those in Postville were caught WORKING. Not being gang-members, DUI's, muggings, or armed robberies. They were contributing to our economy.

Of course you might not be interested in the facts like this. We cannot continue to have a porous border. We do need to regulate who comes and who goes. And I am not condoning immigrants who arrive illegally.
Just the same, let's stick to the facts and reduce the emotional level.
In April 2005, the GAO released a report on a study of 55,322 illegal aliens incarcerated in federal, state, and local facilities during 2003. It found the following:
Of the 55,322 illegal aliens studied, researchers found that they were arrested a total of 459,614 times, averaging about 8 arrests per illegal alien.
They were arrested for a total of about 700,000 criminal offenses, averaging about 13 offenses per illegal alien.
-49% had previously been convicted of a felony, 20% of a drug offense; 18% a violent offense, and 11%, other felony offenses.
-81% of the arrests occurred after 1990
-56% of those charged with a reentry offense had previously been convicted on at least 5 prior occasions.
-Defendants charged with unlawful reentry had the most extensive criminal histories. 90% had been previously arrested. Of those with a prior arrest, 50% had been arrested for violent or drug-related felonies.
Note the last two points – they mean the perpetrators were "previously deported." Regardless, ALL those crimes would have never happened, i.e. were preventable, with serious deportation of the illegal aliens already here and proper border security to prevent both entry and re-entry.
I understand the people caught in Iowa were working. But they were working illegally, using stolen Social Security numbers. I'm glad you agree with me in support of tighter border regulation, and I have enjoyed this discussion. :)

In Conn. a few months ago another illegal murdered a woman and he was deported ...
15 TIMES, now she is dead.
Anyone that is just deported comes back next Tue. There is a cost to find and incarcerate any illegal 1 time, can you imagine what we pay to deport the same illegal 15 times. Some of these crimes are even violent. The cost is small compared to a life.
They call the US 'Club Fed' you come here and when caught we PAY all expenses to go home to see your family, then come back on Tue.
I could see why we have taken this position. Maybe it wouldn't be so bad if when deported, stay deported. They brought this on themselves. In mexico if you are caught illegally, YOU WILL BE ARRESTED FOR A FIRST OFFENSE. I want laws like mexico has.
I've been covering the happenings in Postville since the May 12 raid. One of the things that sticks out most to me is in recent court documents -- the ones filed when two supervisors from Agriprocessors were charged with aiding and abetting. The documents state that the raid resulted in the seizure of dozens of fraudulent permanent alien residents cards from the Agriprocessors human resources offices.
The company, the largest kosher meatpacking plant in the nation, had been receiving warning letters from the Social Security administration for years, indicating that employee information and SS records did not match.
So, it's interesting to note that although there has been a large segment of the workers prosecuted as a result of the raid, only three supervisors from the plant have been charged. (One has fled the jurisdiction -- two are currently remanded until trial.)

One more thought for those who seem to be advocating that illegal immigrants automatically bring criminal activity. While I don't dispute this may be the case in other parts of the U.S., it was not the case in Postville. Following the raid, the company -- through other labor services firms -- was recruiting individuals from Texas to come and work at the plant. These new workers, all of them supposedly having gone through compliance checks for resident status and ability to work, brought a crime wave of sorts to the community. But what is missing here is a real crackdown on the employer. Those big companies depend on illegal workers and maintain recruiting stations in border towns. I think they probably provided the false documents involved.
If Americans can't be hired for the crud work in America, then Congress should create a way of bringing in foreign workers to work legally. The Bracero program worked well. Why can't it be resurrected?

Using false documents on the I-9 form is a Federal violation.
An update on St. Bridget's -- Things are difficult in Postville right now, especially for those who believe their mission in life is to help others. The immediate crisis following the raid left the local food pantry depleted. The press coverage provided somewhat of a buffer as donations came in from across the country. Unfortunately, most of the national press has moved on except for hits here and there on the more controversial aspects of what's happened and is happening.
Roughly 40 women who were initially detained by the feds were then subsequently released on humanitarian grounds to care for children. These women now wear ankle tracking devices so their movements can be monitored. They can't leave the area. They can't work. So, they are dependent on what the community can provide.
To make matters worse, many of those who have come into the community with what they say was the promise of living quarters, a start-up bonus and other perks are not receiving those promised items. These individuals are also relying on the community.
The raid didn't just rock the Postville Hispanic community or leave the Jewish community in a worker lurch. On so many levels it has decimated the whole of Postville.
So where was Potsville before the illegals arrived? I'd bet that if all gang members, in areas where there was alot of gang a ctivity, were arrested, buisnesses would be closing left and right. So does that mean that gang members shouldn't be arrested?

So what's next? Should shoplifters be released because they need to care for their children? Should speeders be releived of their fines because they need the money to provide for their families? Should bank robbers be set free because they just robbed the bank to feed their families?

If we are truly a civilized nation, we must act in a civilized fashion.
We have probably twelve million undocumented immigrants or "illegal aliens" in this nation. How do you suggest dealing with these people?
We can deny them jobs.
And then they will be unemployed.
We can deny them driver's licenses.
And then they will either drive without documentation or be unable to move.
We can deny them healthcare.
And then they will remain ill harboring diseases within their communities threatening the health of all Americans.
We can deny them education.
And then they will be uneducated, not speaking English, and more difficult to bring into the mainstream.
We can do what we did in Postville.
And our economy will lose jobs and the burden of the unemployed will increase.
And yes gangs and crime will increase.
What are your plans for these 12 million?
And then they will engage in deportation-by-attrition.
They will self-deport, especially IF we pressure their home countries to provide properly for them. This would mean, in the case of Mexico, an end to the absurd, obscene 10% annual income tax on Mexico's super-rich, and the creation of job programs, and a safety net for the poor. The biggest obstacle to this happening is support for illegal immigration in the US.
And we can thereby facilitate the process of self-deportation as I just mentioned.
And thereby facilitate self-deportation, and the enhancement of education for them
in their own country, in their own language, as is proper. Again, this must be accompanied by strong pressure from us, upon their home countries (especially Mexico).
No. Our "economy" will not lose jobs. Illegal employers violating the 1986 IRCA
Act, feeding their greed, by hiring cheap, foreign labor will lose jobs, and hopefully they will also go out of business entirely. Because if their business depends upon violating our immigration laws (some of the most pro-poor, pro-working class, protective laws we have), then they have no business being in business. If they can't afford to hire Americans, at American wage levels, then they're no different than all the rest of us who also can't afford that, and they can/should do what we all do - get a job!
The burden of the unemployed (many of whom got that way because of immigration) will be relieved as businesses will be rehiring Americans, or new businesses will arise to fill in the demand gap.
The economy will also be immensely helped by the discontinuance of $45 Billion/year
being lost from it due to immigrant remittances, and tens of Billion$ more, as our tax treasuries return to normal, after the cancellation of massive human services payouts,
as Mexico et al return to paying their own poverty bill, instead of suckering us to so it
for them.
Gangs and crime will decrease here, as gang members self-deport back to their home countries.
1. Enforce the IRCA Act jailing employers for knowingly hiring illegal aliens (control over documentation fraud is necessary for this).
2. Strictly deny human services benefits to illegal aliens (remove incentive to be here).
3. Strongly pressure Mexico and the copycat countries to provide for their people.
This should be economic, diplomatic, and if necessary, tough military action.
Most of the workers that were detained were peasants from Guatemala. I personally sat through the makeshift court proceedings at the National Cattle Congress in Waterloo. I've personally interviewed their wives and family members. This group of people came here for the purpose of work and to provide for their families. Some came here because of horrible conditions in their own country.
Did they know they were entering our country illegally? Yes. I don't remember talking to anyone who said they didn't understand that they were acting in a way contrary to U.S. law.
By that same token, most have no clue what a social security card or number is. They couldn't tell you the purpose of an I-9 form.

Many workers started off being paid cash -- $5 per hour (for slaughterhouse work). As it has been told to me by the workers, after a few months on the job they would be approached by plant management and asked if they would like to get a raise and start being paid by check. When the workers agreed, they were provided documents (information to be used on the I-9 form, laminated employee badges with a name other than their own, etc.)
I don't have time to get into the history of the plant and Postville right now as I have to get to meeting downtown, but I'll come back to the thread later and post.

Then they shouldn't have signed that form...if they actually did. Section 1 of the I-9 form, which is to be filled out and signed by the employee, clearly states...I am aware that Federal law provides for imprisonment and/or fines for false statements or use of false documents in connection with the completion of this form. And if the illegals were acting as if they were ignorant of the seriousness of the I-9 form, then there is an old saying ' Ignorance of the law is no excuse'
And I'm not convinced that the illegals had no clue what a Social Security card or I-9 form is. The selling of fake or stolen SS numbers is too big of a buisness for illegals not to know.

Then the Human Resources manager should be put under the jail along with the Plant Manager.
Well I suppose that we can give them amnesty, but Regan tried that back in 1986 and look how the number of illegals in this country has grown since then.
I say more raids like in Potsville..no jobs...threat of imprisonment for using false documents=self deportation.
So why the crying? Did any poor illegal with fake IDs get shot? If not, then all went well.

I think your plan sounds very good and realistic. Any refute is merely a poor excuse to dismiss flagrant disregard for law and order, and to further set the stage for the kind of anarchy the left calls liberty.
They don't NEED to know what an I-9 form is but they do NEED to have the necessary documentation. Only the companies hiring them need to know what it is. They request the necessary documentation from the people they are hiring. If you go to the link I provided above, and scroll down to the bottom of the page, you will see the documentation that is required for them to produce. If they don't have that documentation that they know they need to produce, and they get false documentation because they know they can't produce it, then they know what they're doing, plain and simple. HOWEVER, as I also said, I know companies let illegals slide and get away with not having it. They should be put out of business. Then we can see how profitable it was for them to hire illegals, in the first place.
As a headhunter who has put countless legal aliens in Computer Science positions throughout the country, I know that the documentation is extensive, and it is very difficult to overlook its validity, or lack thereof, unless you want to.
And, a "study" from Wellesley to support your article? Why not just go straight to Moscow?

The fact is, you still didn't REALLY get it, because it actually makes no difference that Wellesley is in MA. It's private, so it could be in Alabama, and it would make no difference to the point. The same liberal curriculum has no boundaries.

First, every health department and welfare office in the United States of America will be required to see proof of citizenship, including but not limited to a birth certificate, before any food stamps, medicaid, medicare, section 8 housing, etc… will be given. Under no circumstances is this step to be missed. If you aren’t a citizen you may not participate in our tax paid programs. You don’t pay taxes, so you can’t benefit from mine.
2. Next, all landlords will be required to have documented proof that their tenants are either United States citizens or here on a work Visa, student exchange or something equivalent to those. If they have $500-700 dollars per month to pay rent, they’re working somewhere illegally. If we can’t get them at the work place, we’ll catch them here.
3. All illegal immigrants in Federal and State prisons will be deported immediately in the quickest and most convenient way for the people of the United States. If that means piling them into an eighteen wheeler and dumping them off, then that’s what will have to happen. If any violent criminal is found back in the United States of America after being deported, they will be placed on a chain gang for the remainder of their natural life with no pay and clean our roads, pick our produce and make our car tags. They were given two chances and chose not to honor that. They are obviously not able to be rehabilitated. It’s called the consequences of your actions. I know that’s becoming a rare thing, but it’s time!
4. No child born to illegal immigrants in the United States will have American citizenship. This is merely a loophole that our Representatives are refusing to handle. It’s time that they do. We are the ONLY country in the world who offers this stupid clause for anchor babies.
5. Any employers caught hiring illegal immigrants will be fined $25,000 per incident. This money will be returned to the welfare budget of the county/state that the incident happened to replace all that the criminals stole from that area. There are Americans who actually NEED that money and the government assistance programs are almost broke. Largely because of these criminals crossing the border and stealing from our tax programs.
6. There will be no translators provided at public institutions at tax payer’s expense. If you can afford your own translator, they’re welcome to come with you to public schools, courtrooms, emergency rooms, etc… If you can’t afford your own, then you’ll have to learn ENGLISH and assimilate into American society. If not, you know where the border is. Period. This one is an absolute and I think it’s an embarrassment that it hasn’t been implemented yet. Why are American taxpayers paying for the schools, the translators and the education of criminals kids who DO NOT want to learn our language? It makes no sense at all.
7. The fence along the US/Mexican border would be erected. ALL OF IT. The United States service men/women who are RIGHT NOW patrolling, again at OUR expense, South Korea’s border with North Korea would be brought home posthaste and assigned to the Mexican fence. Any caught trying to cross illegally at ANY point other than the specified crossings, would be shot on sight. We’ll assume you’re a criminal, drug trafficker or terrorists or you be would crossing at the areas that are fully monitored.
The fence would have guard dogs along with the patrol as well as cameras that feed to the Internet at all times. This way, citizens could do their part. We could watch and report all activity that wasn’t within our Constitution. After all, this country is run by the American people. It's time we took it back.
Illegals immigrants are NOT integrating into American society in a way that is acceptable to almost 70% of the population. This is a republic and that means that they need to GO. The minority can always move to Mexico and help them out if they’d like to do so.
Are you aware that the main cause of private hospital closings in the last 10 years were due to illegal immigrants? Are you aware that almost 30% of LA county workers are illegal immigrants who DO NOT pay taxes? Are you aware that they are pushing for Aztlan? (look that up if you don’t know what it is) Are you aware that illegal immigrants are the primary cause for the population surge in the US? Are you aware that almost 90% of ALL illegal immigrants participate in American taxpayer paid welfare programs that they DO NOT pay taxes on themselves? (that’s stealing your money)
I don't mow my own lawn either - I have pretty bad allergies and no mower as a result. The guy I get to do it is American - but then I live in Indiana, and we don't have a huge number of illegals here. That would show up wherever you are too. I know a guy who makes $70K a year in 6 months just mowing people's grass, and takes the winter off and does nothing at all. If I didn't have allergies, that's certainly something I'd look into.
