Activist judges have done it again

I know. I was shocked when I heard this on the news last night. Isn't it amazing how the different parts of the government keep grabbing power for themselves that they were never intended to have???????

Yeah, I heard, this was something done by a few misguided soldiers. I don't think terrorists should have rights. They certainly would not provide us with any rights if we captured them.

I was shocked to hear the same. Did you also read or hear on CNN, how the US is supposedly giving $10 BILLION to Afghanistan? I thought it was a typo; but it's true.

What is America thinking of? This is not a Government of the People.. the government does not represent the people of the United States... unless the people are for terrorism.. this just doesn't make sense.

Again folks. It is the system, "stupid." In partisan (party) politics, it is the special interests who rule while masquerading as "servants of the people." What they really are is "servants of some people." I don't think many will disagree with this. What is amazing is that so many of even these people keep supporting the system blindly because they think... 1) they have no better choice, 2) it's not perfect but better than anything else on "the horizon," and 3) In general it does work well compared to other "things." Supreme Court justices are supposed to be impartial (actually all judges are supposed to be impartial), which is a "living oxymoron" since almost all judges are either elected in the party system or appointed by politicians with the distinct expectation that they will act in that party's interests. So that the title, "Justice" is a one word oxymoron.

It is a startling, disturbing, and truly frightening turn of events. In Justice Scalia's scathing opinion, it was apparent he is appalled at the blatant disregard for the constitution exhibited in the majority opinion.

It is really a sad moment for my beloved country.

the Constitution was never meant to apply to non-citizens
this is a mis-guided concept when the rights it affords to citizens is applied to others who are not born here or come here to become subject to the laws
especially should it not apply to terrorists
some 'rights' are lost when one goes to prison.....why should special rights be given to terrorists....this world is so messed up!

I was expecting something like this - Bush has such a low rating that the rats on the ship are running for the nearest wharf so they can NOT go down with the sinking ship. I see no silver lining in the dark cloud assembled about our country right now and a changing of the guard is not going to change very much of the damage already done. Everyone is looking for a new start and to shake off associations of old. But, holding these men forever is not a good thing either - think of the expense and inequity of the situation - they should be tried and their sentences carried out or something other than simply holding them in limbo. I don't want more than 200 martyrs to be made but anything done now will make matters worse. If we had acted immediately, I think even the terrorists would have respected our strength - now we look like old men with no teeth and no stomach for our position, just holding on to the enemy for show.

I think allowing a bunch of lifetime-appointed old folks to overrule the popular vote, the FBI, CIA, Homeland Security and everything else is just plain wrong.
I understand the checks and balances system, but the Executive branch has too much power.

I enjoy reading rants that are backed up with logical thinking - this is one of those. Stupid decisions make me sick, and it's nice to see people standing up against them.

It was a VERY GOOD ruling, one that really surprised me with the reactionary activist judges on this chimpy court.
If people actually read/learned about how these people were brought to gitmo, they may have a much different opinion(for every "terrorist" that was turned in, war lords received a bounty--no evidence, no investigation, just I don't like you and I can receive $50 for saying your a terrorist).
The last time America was so far up their own butt was with Joe McCarthy-and this isn't much different:

• Canadian citizens were "disappeared" into Gitmo--we denied having them
• British citizens were transported to Gitmo
• Chimpy's defense team tried to weasel out of US law by saying that since it wasn't "really" on American soil, only an American base, it didn't count...although it's always counted in the past.
• We are guilty of TORTURE during this occupation and try to lie our way out of it.

I'm with Kim - we also violated the Geneva Convention.

Finally the court starts making a LITLLE show of support for the US Constitution and the anti-American, pro-torture, pro-war crowd starts crying like babes from fear of terrorism. Again and again, I'm disgusted that so many feel NO problem giving up freedoms real people fought and died to give them because some people claim they can protect you from some perceived threat (real or unreal) . . . spineless cowards.

You people may not mind children and innocent people being picked up, held and tortured in your name, but I damn sure do.

I have agree to disagree here. I am of the mind that everyone should have basic human rights. Just because they're not American citizens doesn't mean they should be held in prison without a trial, or be beaten, starved or any of the other things that were perpetrated on them.
They are human beings that should be tried and found either guilty or innocent by a trial of their peers.
I don't condone any terriostic acts, but, I also don't like when I hear about another person treated unfairly.
It all goes back to the bible again when Jesus said, "He without sin cast the first stone." "Judgement is mine, sayeth the Lord." Let them be judged by a God or other ways that are humane.

So, Andrea, the reason they shouldn't have the right to challenge their detention is because they're "non-citizens"? (Not citizens of the United States, I assume).

Millions of Americans live abroad, and other millions travel outside the US every year. Do you want other governments to apply the same principle to them? Should those foreign countries be able to detain American citizens and not even have to justify those detentions? Or would you be screaming bloody murder and demand that those countries be bombed back to the Stone Age if that happened?

To Nunya, Sandy and Aniko - first, let me thank you for crawling onto one of my posts and giving me points. Second, let me address my Christian beliefs with you regarding the terrorists. The Bible says that we should not murder. It does not say we should not defend ourselves, or make war with others who would kill us. There is a big difference between murder and kill. When we have terrorists who are actively trying to kill Americans or other infidels simply because they are not Muslims, then yes, that calls for detaining them indefinitely to keep them from carrying out their insidious plans.

I am not a terrorist. If someone in another country held me against my will indefinitely, then I would think that my country would do everything possible to get me back, seeing as how I did nothing wrong. There is no official country trying to get these detainees back, now is there?

Thank God that five Justices of the high court remain concerned that guilt or innocence are improtant considerations in applying penalties (and torturing).

I am shaking my head at the leftist rants on this post. The Bible does not consist of just the New Testament. The Old Testament, which is full of war, is just as relevant as the New Testament. God, as the Trinity, IS a God of Love, BUT He is also a God of Judgement, and one to be feared. Humanity cannot wrap their small minds around the awesomeness that is God and understand it all - but it is so.

I am truly sorry that you cannot understand our Constitution the way it was originally intended to be understood. It just is - it is NOT a living, breathing document, as activist judges want it to be. Marbury v Madison began this nonsense with judges thinking they could be above the Constitution and write for all intents and purposed their own law. Unfortunately, that rule of law has not changed since and has only gotten worse, especially with Democrats in control.

This country is dire need of prayer. We are in trouble - but not because of the reasons that most people think. We need to turn our attention back to God and when we again have God at the center of our lives and our country, then our country will thrive again.
