When I wrote about the Texas child rustling case (the taking of the 400+ kids from the polygamists) on May 5th, I questioned the ethics of it. Although I suspect there are some cases that could proceed legally from all of this, I don't feel there was compelling evidence that all of the children were involved.
I'm sure the powers to be at the Texas Department of Child Protective Services bureaucracy thought their day in the sun had arrived, and Judge Barbara Walther probably drooled over the dream of her own television show, "Judge Babs".
You can not tell me that at any time the welfare of the children was the main issue. It just doesn't ring true.
Now the Texas Supreme court has ruled that the whole ordeal was illegal, but Judge Walther rejected their decision and has order the children kept in custody.
A few hours ago, it was reported that the Child Protective Services has been placed under investigation.
No matter what was done wrong at the Zion Ranch, you do not place everyone under (or behind) the same blanket of shame. You do not take that degree of action on unsubstantiated hearsay. If it is allowed here, none of us are safe. It totally weakens and dilutes our ability to help real victims.
Texas Dept. of CPS should be sued and the plaintiffs awarded millions. Judge Walther can't be sued, but she can be disbarred and sent to jail, which is where she belongs. No one is above the law, including a judge.
It is hard enough these days (with the myriad of laws on the books) to tell who is a criminal and who isn't; however, in this case, it is obvious to me who are the real Outlaws in Texas.

What I am saying is by not adhering to the law and ethics in this situation, we are opening up a Pandora's box here. If these bureaucrats and judge can get away with this, none of us are safe. The higher courts have ruled just that.
It is similar to the crap that is disguised in the Patriot Act under patriotism. How about when they did warrant less searches in Cabrini-Green Green in Chicago? How about all of the destruction of property and death of occupants caused by police serving "warrants" acquired by hearsay on the wrong addresses, a common occurrence?
No matter how apparently justified all of this may appear, it has not only been handling improperly, unethically, and illegally. Heads should roll.
We just can not allow the "government" to bulldoze us. Obviously, I am serious about this.
These children - like all our children - deserve to be protected - but here we have a case where the goverment agencies just ride roughshot!
It has already been shown that not all families within that complex - so they don't even live in the same house - actually practice the same - not all marry their 12-13-14 year olds to an old man of 40.
I am not fond of their religious persuasion and practices, but this was not a cult and it was not hard to leave as is and has been the case in other such models.
I am appalled to hear that Judge Walthers decided to keep the children in custody against the Texas Supreme Court ruling - who the hell does she think she is?
Children services is supposed to protect our children - heck there were several included that were already adults!
They undoubtedly overreacted on a phone call, wish they'd show this fervance in some of the single abuse cases where they decide to leave the child. Oops the dad killed the little one a month later.
They manage to find a place for 250 plus kids?, but often can't find a place for just one placement?
I couldn't agree more that this case weakens and dilutes our ability to help children that are in dire need - now and in the future.

...and yes, this is a case where the government rode roughshot over it's citizen to prove their might!
As you said, how in the world did they find housing for these kids? As far as I'm concerned no matter where they were, it was the equivalent of prison. Why did any of them deserve this?
There could have been some kind of quarantine, house arrest (what's the difference than what they had), or confined to the compound (just don't burn it down they way they did the Branch Dividians in Waco).
There were many legal and ethical ways of handling this. Maybe take them from one family and move them to another in the compound temporarily, just let them in their own culture until this sorted out.
Everyone talks about protecting the children, but it seems to me in the end there is more CYA and ego here.
Who the hell does she think she is? So far there is no proof of anything in this case.
After writing this, she might demand I take the tests?
Where is this going to end? Those of you that are trying to justify all of this need to take a closer look. Your freedoms are being flushed right down the ol' toilet, and you are applauding.
