Freaky Situation Need advice...

Ok heres the story me and my hubby, and ma are all living together at the moment and we have lived in the same trailer for a lil over a year well my mom moved in back in nov of last yr and yet we have alot of problems with our trailer like the fridge freezes everything we got one big freezer, our tub leaks and sprays everywhere, the floor in the bathroom is now very week, the water heater is about to bust is rusted badly, the water  stinks because of it, and we only have like 2 mins of hot water. Out of all these things he's known about for quiet awhile, we've wrote him letters and talked to him face to face yet never fixes anything. Ok then in Jan he offered us the trailer beside us and yet he had to fix some things there first and again never did it so now he's tryin to charge us for this trailer and that one yet we live here. It s comlicated but my question is what would ya'll do in this situation? would u continue to pay rent or not?

Sounds like a messed up situation. I don't understand all of it but I am sure everything will work out eventually. Besides you've already gotten some good advice already. Good luck.

not necessarily true. It depends on local laws and wording of your lease. You should open an escrow account. You continue to pay rent , on time, into the escrow account. He doesn't get the money, but if necessary, you can demonstrate to a judge that you are not a deadbeat.

I agree with WM H's comment. Also, if you haven't been keeping documentation of your dealings with him, start doing so, otherwise it's your word against his. Every time you talk to him, start marking down the date, time and what was said between you and him. If it ever came to a legal battle, you'll have the documentation to back you up.

Also, check your lease, if it states that the property owners are supposed to fix the trailer when there is a problem, then you might want to point it out to him. Possibly let him know that you are putting the rent into an escrow account and when the trailer is fixed, let him know he'll get his rent. Tread very carefully, you might wind up hurting yourselves more than helping the situation.

If you want to stay I suggest taking him to court. If not move as soon as you can. No one should have to live that way.

I would contact your local "Legal Aide" first. But if you can't do that. Then the advice you've gotten so far is good. Document everything. Pictures with dates. Use a newspaper to prove the date. Talk to your local bank about an escrow account. That will be your proof that you are paying your rent. Your just waiting for things to get fixed. And if it gets any worse, I would pay for the fixing of the problem and then deduct it from the rent. Again use the newspaper for proof of date.
I hope your situation get better.
You do still have to pay. BUt the money get sput in escrow account until the landlord fixes all the problems.

To make things simpler. Just move to a different place. I hate slum lords like this. My FIL is one of them.

I would threaten court and see if that helps. If not.. then I would get myself a damn good lawyer.

Get dated pictures of everything is wrong. Write him formal letters that you can make copies of. He is obligated to fix these things for you.
