Over 2,000 calls have been made through our Citizen Generated Whip Count. Thus far, we've been able to solidly confirm where five out of nineteen senators on the Judiciary Committee stand on retroactive immunity. Senators Feingold, Biden, Kennedy, and Cardin are all in the right place. Only Senator Kyl stands publicly in favor of retroactive immunity for telecom companies. With four Senators publicly opposing retroactive immunity in FISA reform legislation, we only need six more votes to kill retroactive immunity in committee.
The good news is that last week's hearings showed Senators Leahy, Feinstein, and Specter opposing retroactive immunity in principle -- but they haven't yet taken a firm stand on how they will vote.
Mark-up of the FISA reform legislation could be happening as early as this week. Now is the time to call the Senate Judiciary Committee and ask them to oppose retroactive immunity for telecom companies.
