I am filling in for William again tonight and hope we will all be of good cheer and welcome one another. I am in the middle of a severe thunderstorm area also and it is thundering and raining now. If I leave suddenly you will know I had to get off the computer.
I have received replies to my letters to Gather which I would like to share with you.
Tom Gerace responded to my letter to him on 6/20/07. I shared Mary Anne's response last evening.
Audrey,
Generally speaking, copyright law and fair use are very complex. Many times how they are applied can vary depending on the type of content involved. As you know, copyright law is not determined by Gather; rather we strive to make sound decisions regarding all concerns brought to our attention. We are all aware that many social media sites have been in the news on a regular basis because of how they are addressing these issues on their sites.
For the time being, Gather is permitting jokes that have been forwarded via email to be shared on gather. They should be cited as coming from an email, and they should not be a comic’s routine. Gather staff is actively working with experts in the copyright field to ensure our policies and processes are always within copyright law and fair use guidelines as this area evolves. If we learn of any changes needed on Gather.com’s stated policies, those changes will be clearly communicated to the membership.
Best,
Tom
This morning I noticed that all three of the articles for this group were flagged and I wrote this to Tom.
Tom, Last night I filled in for William M on the Good Evening Gather article. It was published in three segments due to the length of each and downloading time for many. The second article was flagged last night. In the past hour, since 11:30 AM CDT someone has flagged the other two segments, stating copyright violation.
>
> I would like to know who is doing this. According to the fair use segment of music copyright laws it is not a violation to used quotes from songs if it is not for profit and the performer/writer is identified. In all cases but one last night this was done. It seems that someone is being overly zealous in this matter and wants the evening articles to disappear. Perhaps this is because of the popularity of them. These articles bring a lot of viewers to Gather that might otherwise not be here.
>
> Please do me the service of explaining Gather's viewpoint on music copyright laws, and tell me who is flagging my articles. I think anyone who flags should have to leave their name on the article as the person responsible for flagging it.

> Sincerely,
> Audrey Hauser

I received this reply from Carolyn Richards.
Dear Audrey,
This is Carolyn Richards contacting you on Tom's behalf. I have checked on your article and have reviewed the content report that was submitted to Gather last evening.
Song Lyrics are copyrighted and by law cannot be republished without proper permission. We are actively working with the members who posted the song lyrics to have their comments removed, at which point in time your article will then be released back onto Gather.
Given the tremendous volume of content that is published on Gather during any given day, we rely on our members to alert us if and when they identify terms of service violations on the site. Likewise, we expect that members will leverage this report system appropriately and not abusively flag content because they do not agree with the publisher's point of view.
With regards to content reports, Gather has recently implemented several changes so as to ensure that reported content is reviewed within the day that it is reported. Articles or images whose reports are deemed to be invalid are acknowledged and released by Gather Editorial as quickly as possible. And, as we identify cases whereby individuals are inappropriately flagging content, we will attempt to further educate those members on our policies and procedures. If a member fails to adhere to our policies after he/she has been contacted 3 separate times by Gather, his/her account is then closed.
Gather treats every community issue that is brought to our attention, objectively and fairly. If there are specific situations whereby you feel a Terms of Service violation has occurred that we may have overlooked, please e-mail me back with links to the articles and/or comments in question, as I would be glad to look into them for you.
Thanks in advance for your patience as we work through this issue. Should you have any further questions or concerns please do let me know.
Regards,
Carolyn

From this time on I will ask that no lyrics or other copyrighted items be published in comment here. We can still talk about our favorite songs however. I do feel that there is a overzealessness on this subject where Gather is concerned, but let's not give them and reason to question.
Now let's settle in and have some fun/ I will supply refreshments and since gather is currently allowing jokes forwarded in email you can share those as long as you state it was in your email.
I think we have some fine budding comics here so be innovative and do some of your own jokes. Come on Greg, you know you are dying to tell some jokes.

How is everything back in the states? I haven't been here in ages! <33
I meant to stop by last night but I fell asleep on the chair and didn't wake up until after 1AM (then I couldn't sleep)
I'm beginning to read the letters Audrey. It all sounds very interesting to say the least. Have you been doing much singing lately? <33
thanks JF - it's our new babies - I'm soooo excited that they are finally here!!
Robin Hatchlings
the 3rd one hatched this morning and I have a new picture - I need to get it into photoshop and then uploaded...so everyone can see them.... this new picture you can see the little beaks - but the eyes are still all closed - but you can at lease see little faces...
So much has gone on since I've been able to come on and have a chat. My goodness. I hope things smooth over soon
I don't know how much longer I'm going to be able to stay on because my internet might be turned off soon. It is 1.20am afterall.<33
At least that isn't copyrighted or is it?
Thanks for trying Jeff.
have a great night everyone!
Dan, I don't get it but I think the jokes are ok from what Tom sent back. That was a good way to word the question I think.
Hi Karen, how are you this evening?
William did you notice Caite is here all the way from Merry Old England.
England is nice and I'm so happy to be here. <33
Caite, It has been a long time. I hope things are going well for you.
Hi, Dan. I hope you are OK.
It is good seeing you J F.
Janelle, you are always a welcome sight.
Larry, I am always glad to see you around.
Hello, Marsha. It is nice seeing you.
Hi, Lisa. I hope you are making it OK.
Jeff, you are a welcome sight.
I'm on dialup and don't think I'll be able to keep up well with everyone and everything. I hope I did not miss anyone.
Dan, I asked that same question in a comment, and no one answered me either. It was the only way they could get Gather to do anything, I guess. And I agree, some of the jokes that get posted here have been around ever since I first got online. If there was a copyright problem, I'm certain it would have come up by now!!
Lisa, it's great to have a nest where you can watch and take photos! I had the same pleasure last year with a nest of barn swallows.
I will be back in a couple hours.
Y'all have fun.
Janelle, thank you....hope they sort it out soon...
It seems so funny but all my lyrics are found on the Internet...and besides I own each of them...it's there some ownership rights involved there...but I digress...
I've missed you too, Linda.
I hope you can stay on for a while, Caite.
Thank you, J F. That means a lot.
That sounds like a winner, Dan.

For me, there are certain things that need to be 'copied in total' by the source to maintain the message given. Public service announcements & news stories, for instance. Giving the whole reference without error - is the way I see the correct credit is given.
OHHHH Linda what kind of pie?
I haven't done much commenting today and I want to check in on a few of my connections before I log off.
Good night.
We had a little rain here in the hills of WV a couple of nights ago, but for the most part, we've been really dry so far.
Hi Marsha I will repub;ish when it gets to about 100 comments so it will download faster.
Ain't it grand that Caite can join us, Audrey.
You will have plenty of tomatos there, Larry. I know you other plants are looking good. Maybe you will get some rain soon.
Are you always hungry like me, Janelle.
Audrey, that looks fantastic. You are sure it is not copyrighted. Don't want to eat and drink the wrong stuff.
Well I don't have a license to serve licqour so I'd better be careful.
Oops Audrey, I drank the evidence. I'm a guzzler when I set my mind to it.
J F, I think it was you that asked what I've been doing. I'm watched TV more than in months. I read a book for the first time since last summer, and got more done outside than in a long time. Thanks for asking.
Hi, Lynn. It is good to see you.
If I'm missing anybody or anything, I'm sorry. Slow typing and slow download make it hard keeping up.
Hi Audrey, thanks for the link, I do
appreciate that so much my good
friend. I'm starting to wind down,
have had a busy day. I teach a
class on Bone Building tues/thurs
for an hour, I have lots of people
that come to join the class. My

gals and guys. Have a great nite
all you people.zzzzzzzzzzzzzz
My take on the responses to my questions about music copyrights is that they are being overzealous on the side on infringment. I sing with a chaoir representing one of the largest teaching hospitals in the country and the legal department check out the issure of copyrights. We are not sining for profit and even though our music is not all purchased(as in donated or borrowed) we are legal to sing it. I have had numerous replies from members here who deal in copy right issues who also say this. I will let Gather work on it for awhile.
